How am I supposed to update to iOS 9 if I’m not allowed to update to iOS 9?

I just got a wonderful little email from Apple informing me that if I wish to continue backups on my devices I will need to update to iOS 9 at least.

That’s a bit of an issue for my original obsolete iPad which is still on iOS 8 something that will not allow me to update it to iOS 9 because it will not allow me to sign in to iCloud because it’s still on iOS 8 due to a software issue restricting that, or so I was told by Apple support.

For context I’ve had other issues with this not allowing me to upload photos to the cloud from this particular device because it won’t allow me to sign in to iCloud.

So in the most basic terms I need to update but I can’t update because I need to update and if I don’t update I can’t backup anymore…..just why Apple?
