Is this a used device that is “New” to you?
If So, what to do:
I. You Need to Contact the Seller:
Whomever the seller is, they need to log themselves out of this, if not your account.
II. Where was this Purchased?
A. Online?:
If this was purchased online (i.e. eBay) then contact the site, seeing if the seller can be held accountable and if you can get your money back.
B. In-Person?:
If this as purchased in person, then there may be nothing you can do but contact them, asking for your money back.
C. At a Retailer?:
If purchased at a retailer, take it back, asking what your options are for a return.
Or...
D. From Apple?
If purchased from Apple, then contact Apple Support.

Note: Phone calls are taking a bit to go through at the moment, due to lots of calls. With the Coronavirus Pandemic, many are at home at the moment, with much time on their hands to contact Apple. So, just stay on the line, and you will get through :)

Bottom Line: If the phone is activation locked, you've been ripped off. Apple won't help you. We can't help you. Either get the seller to remove activation lock or if they can't, get your money back. And if neither is possible, recycle the phone responsibly as it will be useless to you.
