Can I restore all my data from my previous iphone to the new one with Icloud without the photos?

I want to use the same apple ID to restore in my new phone all the data such as contacts, apps, messages… but I don't want any of the photo from my previous phone to the new one.

You can restore the old phones iCloud backup to the new one. And on the new one just turn off iCloud photo so those phones don’t sync down onto it. Assuming you’re using iCloud photo, then photos are not part of your backup. They would sync from iCloud photo onto the new phone after initial setup is complete.
