Questions about AirPods Pro replacement parts

I requested a replacement part for my airpods pro. I received an email (screenshot attached) saying that if my original device is ineligible for service, my non-return funds will be charged. Has anyone been charged for this before? Can I cancel the service if it’s determined ineligible?
