transferring information

I have just got a new mac. I want to transfer from my 2009 mac running El Capitan.

I know how to do it via time machine from a external hard drive.

Please can any one tell me does it put the old OS on my new mac?

all I want to transfer is photo's, video and files.

Its my first time doing this.

No, it does not put the old os on the new machine.
