Is Apple Pay subscribing me to vendors emails when I purchase goods online?

I NEVER subscribe to emails when I make a purchase online. And yet I have been having trouble with companies putting me on their email lists after I make a purchase. I made a purchase from NutPods this morning and while it was processing my Apple Pay, I noticed at the very last second that the subscribe to email box got checked off. I did not check it off; it was generated by the computer, and it happened so fast I did not have a chance to uncheck it. I know some information has to be shared by Apple Pay, but subscribing me to emails is not something I want. Or is it the vendor doing this? If Apple Pay is doing it, I probably missed that part of the looonnggg user agreement. But it is a deal killer for me.
