Photos automatically deleting IOS 18.1

I have an iPhone 16 Pro Max running 18.1. Since being on 18.1 I have noticed photos deleting from my phone and they are not showing up in Recently Deleted folder either.

I went to iCloud on my Mac and the photos aren't showing in there either. So I performed a reboot, back-up, made sure everything is toggled on the way it's supposed to be and noticed after this more photos are deleting.

So then I did a complete reset, erased everything and started over as new and not from a back up and even after this had a few more photos delete/disappear.

Currently my iCloud+ storage is 200GB and I'm using 89.6GB of it so they are deleting because I don't have enough storage either.

Any suggestions or anyone else experiencing this issue. I've experienced many other issues that I keep being told are "bugs".
