How would I unlock an IPhone that unfortunately hasn't been backed up? And without deleting the photos on the phone? Thanks

There is no way. Backups must be made before you need them. Are you sure you didn't sync your photos to iCloud? To Photo Stream? To any of the dozen or so cloud based photo archives such as Google Photos, Shutterfly, Dropbox, box.com, etc?
